Noncompliant Submissions

Noncompliant Submissions
If the documents and information submitted by the petitioner do not comply with the provisions pertaining to submissions for confirming the validity of an arbitration agreement or enforcing or vacating an arbitral award, as the case may be, the court will request the petitioner to make corrections and additions or additional submissions, where appropriate. If the submissions still fail to comply with the provisions, the court will make an order to reject the petition.

Submission to a Court without Jurisdiction
If the court that receives such a petition has no jurisdiction over the case, it will notify the petitioner to submit the petition to a court of jurisdiction, and will make an order to reject the petition if the petitioner insists on submitting the petition to the same court.

Right to Appeal
If such a petition is rejected, the petitioner has the right to challenge the order of rejection by filing an appeal.
