Dismissal of a Petition for Judicial Review
After a court has admitted a petition for judicial review, whether for confirming the validity of an arbitration agreement or enforcing or vacating an arbitral award, the court will review the case and make an appropriate order.
If the court holds, after the review, that the petition it has admitted fails to comply with the requirements for admission, it will make an order of dismissal.
In such a case, the petitioner may file the petition again after making corrections and/or additions in accordance with the requirements for submission.
After receiving the re-submitted petition and other documents, the court will review again and make an order to reject or admit the petition.
If the petition is rejected again, the petitioner also has the right to challenge the order of rejection by filing an appeal.
