Time Limitations in Cases Subject to Judicial Review

1. Time limitation for accepting or rejecting a petition
Within seven (7) days of receipt of a petition for judicial review, whether for confirmation of the validity of an arbitration agreement or for enforcement or vacation of an arbitral award, the court should review the case and admit the petition or make an order of rejection of the petition.

2. Time limitation for notification
Within five (5) days of admission of a petition for judicial review, the court will notify the claimant and the respondent of the admission of the petition and inform them of the rights and obligations relating thereto.

3. Time limitation for challenge over the jurisdiction
Within fifteen (15) days of receipt of a notice from the court, the respondent may challenge the jurisdiction of the court that has admitted the petition. The court will review the challenge and make an order on the challenge. And the claimant or the respondent may challenge the order by filing an appeal.
In the case of a respondent without a domicile in the territory of the People’s Republic of China, the time limitation to challenge the court jurisdiction is thirty (30) days of receipt of a notice from the court.
