Time Limit for Withdrawing a Petition for Judicial Review
Time Limit for Withdrawing a Petition for Judicial Review
If a petitioner intends to withdraw his petition for judicial review, whether for confirmation of the validity of an arbitration agreement or for enforcement or vacation of an arbitral award, after his petition has been admitted by a court, the petitioner should submit a request for withdrawal to the court before the court makes a final decision. The court shall approve the request submitted before a final decision is made.
If a request for withdrawal of a petition for judicial review is submitted after the court has reviewed the case and made a final decision, the request will be rejected and the court’s decision will become effective and binding.
