Jurisdiction of Enforcement Cases
Where the winning party seeks enforcement of the award, he may file a petition for enforcement to the intermediate court in the place where the losing party’s domicile or property is located.
The intermediate court that receives a petition for enforcement will appoint a collegial panel to review the petition and make inquires of both the winning party and the losing party.
Where necessary, the intermediate court will seek explanations from the arbitral tribunal that made the award or request the arbitration institution to deliver the case files.
After the review, the intermediate court will make an order to enforce or vacate the award, which may be served on the arbitration institution. The intermediate court may also make an order for re-arbitration at the request of the disputing parties and notify the arbitration institution of the same.
