Failure of an Enforcement Action

Failure of an Enforcement Action

The enforcement court shall complete the enforcement of an award within six (6) months upon receipt of a petition for enforcement.

In case of the enforcement court’s failure to complete the enforcement action within the above time period, the petitioner may file a petition with the court at the next higher level to enforce the award.

Upon receipt of such a petition, the court at the next higher level will review the case and may:

(1) take an enforcement action on its own initiative;

(2) order the original enforcement court to complete the enforcement of the award with a specified time period; or

(3) order another court of competent jurisdiction to take an enforcement action.
