Request Another Court to Take an Enforcement Action

After a court receives a petition for enforcement of an award, it will review the petition and make an order for enforcement or dismiss the petition as the case may be.

If the court makes an order to enforce the award but the domicile or property of the obligor under the award is in another jurisdiction, the court may request a court in such jurisdiction to take an enforcement action.

The court that receives such a request shall take an enforcement action within fifteen (15) days of receipt of the request. Such a request shall not be rejected by the requested court.

After the requested court has completed an enforcement action, it shall notify the requesting court by a written notice promptly.

If the enforcement action has not been completed within thirty (30) days of receipt of the request, the requested court shall inform the requesting court of the details of the enforcement action.

If the requested court fails to take an enforcement action within fifteen (15) days of receipt of the request, the requesting court may request the next-higher-level court of the requested court to order the requested court to take an enforcement action.
