Succession to Debts of Deceased or Terminated Obligor in Enforcement

After an award has been made, the obligor under the award should pay the debts to the obligee within the period of time specified under the award. If the obligor fails to pay his debts before the termination of the performance period, the obligee may file an application to a court of competent jurisdiction requesting enforcement of the award.

If the obligor dies, in the case of an individual, or is terminated, in the case of an entity, the obligee may request to enforce the estate or remaining asset of the obligor.

If the estate or remaining asset of the obligor is inherited or placed under custody, the application for enforcement may be filed against the heir, administrator, or manager of the estate or remaining property.

In the absence of an heir or administrator or a manager, the estate or remaining asset will be at the disposal of the enforcement court.

If the estate or remaining asset is claimed by two or more obligees, the claims of such obligees will be satisfied in the order of priority after a public notice for claims has been published and has expired.
