Compulsory eviction. In the case of compulsory eviction of a party against whom enforcement is sought from a house or land, the president of the people's court shall sign and issue a public notice to order the party to vacate within a specified time period. Where the party against whom enforcement is sought fails to vacate within the specified time period, the enforcement officer shall take compulsory measures.
Where compulsory measures are taken, the enforcement officer shall notify the party or an adult member of his family if the party is an individual, or the legal representative or principal of the party if the party is a legal entity or other organization. Their refusal to be present shall not prevent the enforcement action from proceeding. Where a party against whom enforcement is sought is an individual, his employer or the local competent organization in the place where his house or land is located shall designate a person to be present. The enforcement officer shall make a written record of the compulsory enforcement action, which shall be signed or sealed by the persons present.
In the case of compulsory eviction of a party against whom enforcement is sought from a house, the people's court shall designate a person to deliver the property moved out of the house to the party at the designated place. Where the party against whom enforcement is sought is an individual, the property may be delivered to an adult member of his family. Where the party against whom enforcement is sought refuses to accept the property, he shall bear the damage to or loss of the property due to preservation of property.
