Settlement during an Enforcement Action
The winning party may file a petition to enforce the award if the losing party fails to perform its obligation under the award.
During the process of an enforcement action taken by the enforcement court, the losing party may reach a settlement agreement with the winning party and request the enforcement officers to make a written record of the terms of the settlement agreement.
If such a settlement agreement is reached due to fraud or under coercion by the losing party, or the losing party fails to perform the settlement agreement, the enforcement court may proceed with the enforcement action and enforce the original award at the request of the winning party.
