Civil Code: Termination of an Adoptive Relationship (Articles 1114 – 1116)

Article 1114 The adopter shall not terminate the adoptive relationship before the adoptee attains to the age of majority unless agreed by the adopter and the person placing the child for adoption. Where the adopted child has attained to the age of 8 years, the consent of the minor shall be obtained.
Where the adopter fails to perform the obligation to raise the adopted child or damages the legitimate rights or interests of the adopted child by maltreatment, desertion, or otherwise, the person placing the child for adoption may demand that the adoptive relationship be terminated. Either the adopter or the person placing the child for adoption may file a petition with the people's court for termination of the adoptive relationship in case of their failure to reach an agreement thereon.

Article 1115 Where adoptive parents and the adopted child who has attained to the age of majority cannot live together due to deterioration of their relationship, the adoptive relationship may be terminated by an agreement. In case of their failure to reach an agreement, either may file a petition with the people's court.
