Section 3 Validity of Civil Juristic Acts

Article 143 A civil juristic act of a person shall be valid if

(1) the person has the civil capacity for such an act;

(2) the intention manifested by the act is true; and

(3) the act does not violate the mandatory provisions of laws, administrative regulations, public policies, or ethical standards.

Article 144 The civil juristic acts performed by a person without capacity for civil acts shall be invalid.

Article 145 A civil juristic act performed by a person with limited capacity for civil acts shall be valid if it is solely beneficial to or commensurate with their age, intelligence, and mental conditions, and any other civil juristic act performed by such a person shall be valid only upon the consent or ratification of their legal representative.

The counterparty may, by notice, demand the legal representative for ratification within 30 days of the date of the receipt of the notice. The legal representative's failure to respond shall be deemed its refusal to ratify. A bona fide counterparty may revoke a civil juristic act before it is ratified, provided, however, that revocation shall be effected by notice.
