Civil Code: Tenancy of Rural Residential Land

Chapter XIII Tenancy of Rural Residential Land
Article 362 A tenant of rural residential land shall have the right to possess and use the collectively-owned land under its tenancy according to law, and may use such land for the construction and erection of residences and their ancillary facilities.
Article 363 Tenancy of rural residential land shall be granted, exercised, or transferred according to the laws on land administration and other applicable laws and administrative regulations.
Article 364 Where any rural residential land is destroyed due to a natural disaster or any other cause, the tenancy of such land shall be extinguished. Villagers whose residential lands have been destroyed shall be granted new residential lands according to law.
Article 365 Where the registered tenancy of any rural residential land is transferred or extinguished, an application for alteration or deregistration shall be submitted to the competent registration authority in a timely manner.
