Pricing Rights of Business Operators

(1) Independent pricing right: It refers to the right of business operators to independently determine the prices of their goods and services in accordance with the Pricing Law. Specifically, business operators have the right to:
① independently fix prices that are subject to market regulation;
② fix prices within the range of government referential pricing; and
③ fix the trial sale prices for their new products that are subject to government referential pricing or government pricing (except for specific products). The trial sale price is the price of a product during its trial production stage. New products generally refer to products that have not been produced nationwide or products that have been substantially improved and innovated on the basis of the original products. New products in the trial sale stage generally have high costs and small production volumes, so even for products that are subject to government referential pricing or government pricing, the independent pricing rights are still vested in business operators. This is an exception to government referential pricing and government pricing. However, not the trial sale prices of all new products are independently determined by business operators. For certain specific new products that are related to the national economy and people's livelihood, their prices during the trial sale stage should still be subject to government referential pricing or government pricing. Such specific products are determined by the pricing authorities.
(2) Right of suggestions.
(3) The right to report and accuse: refers to the right of the business operators to report and accuse any act that infringes on their lawful independent pricing rights. It is a legal measure to guarantee the independent pricing rights of business operators.
