A man who has attained to the age of 22 years and a woman who has attained to the age of 20 may enter into a marriage according to the Civil Code of the People’s Republic of China.
If a man or woman under the above legal age for marriage enters into a marriage under coercion or for other reasons, either spouse or their close relatively, including their parents, grand-parents, grand-parents-in-law, and adult brothers and sisters, whether full-blood, half-blood, or adopted, may file a case to claim revocation of the marriage.
A case for revocation of such a marriage should be filed before the underage spouse attains to the age of 22 or 20, as the case may be. If a case for revocation of such a marriage is filed after the above deadline, the case will not be admitted by the court or will be dismissed if it has been admitted, unless the marriage is a forced marriage and is hasn’t been one year since the date of marriage.
And if such a case is filed by a close relative of either spouse, and both spouses have attained to the legal ages for marriage and are not willing to get a divorce, the claim for revocation of their marriage will not be sustained.
