Seat of Arbitration
Generally, an arbitration agreement or arbitration clause should specify a seat of arbitration. But in practice, the seat of arbitration is often omitted due to negligence or other reasons. In such a case, the disputing parties may agree upon a seat of arbitration.
If they fail to reach such an agreement or their agreement is not clear enough to determine a specific seat of arbitration, the place where the arbitration commission or institute is located will be deemed the seat of arbitration, or the arbitration commission/institution or the arbitral tribunal may specify a place as the seat of arbitration.
Any award made at the place specified by the arbitration commission/institution or the arbitral tribunal will be deemed to have been made at the seat of arbitration.
