Scrutiny of Draft Awards

Scrutiny of Draft Awards

After any award has been made, the arbitral tribunal or sole arbitrator shall not sign it before submitting its draft to the arbitration commission for scrutiny.

In the scrutiny of a draft award, the arbitration commission may make proposals or suggestions on the form or sustentative issues, or propose modification of the draft award; provided, however, that it shall not interfere with the independence of the arbitral tribunal or sole arbitrator in deciding on the award.

For more detailed rules pertaining to scrutiny of draft awards, please refer to the applicable arbitration rules agreed upon under your arbitration agreement.
