Sole Arbitrator or Three Arbitrators

Different from the arbitration systems of most countries, the Chinese arbitration system specified only two types of arbitral tribunal, i.e., sole-arbitrator tribunal or three-arbitrator tribunal.

In the case of a sole-arbitrator tribunal, the sole arbitrator may be appointed by the claimant and the respondent by agreement or appointed by the chairman/president of the arbitration institute at the request of the claimant and the respondent.

In the case of a three-arbitrator tribunal, each of the claimant and the respondent may appoint, or request the chairman/president to appoint, an arbitrator, and the two arbitrators appointed will jointly appoint a third arbitrator to act as the presiding arbitrator.

If the claimant and/or the respondent fail to make an appointment, the chairman/president will make an appointment in their names.
