Resolution of Economic Disputes: Administrative Reconsideration
II. Jurisdiction over Economic Disputes
Jurisdiction over economic cases refers to the division of labor and authority for accepting first instance economic cases between superior and subordinate people's courts, as well as between people's courts at the same level. It can be divided into four types: hierarchical jurisdiction, regional jurisdiction, transferred jurisdiction, and designated jurisdiction.
(I) Hierarchical jurisdiction
Hierarchical jurisdiction of economic cases refers to the division of labor and authority for accepting first instance economic cases among people's courts at all levels. Such division of labor is mainly based on the following four aspects: ① The nature of the case; ② The amount of the subject matter in dispute; ③ The complexity of the case; and ④ The scope of influence of the case. A lowest people's court has jurisdiction over all first instance economic cases except those under the jurisdiction of their superior people's courts. An intermediate people's court has jurisdiction over three types of economic cases of first instance, i.e., major international cases, cases with significant influence in its jurisdiction, and cases determined by the cases determined by the Supreme People's Court to be under the jurisdiction of the intermediate people's court. A high people's court has jurisdiction over economic cases of first instance that have significant impact within its jurisdiction. The Supreme People's Court has jurisdiction over cases that have significant impact throughout the country and economic cases of first instance that it believes should fall under its jurisdiction.
