PRC Arbitration Law: Composition of Arbitral Tribunals – 4

Article 37 Where an arbitrator becomes unable to serve due to removal or other reasons, a new arbitrator shall be selected or appointed in accordance with the provisions of this Law.
 
Where a new arbitrator has been selected or appointed after the removal of an arbitrator, the arbitral tribunal may decide, at its sole discretion, whether to repeat the proceedings at the request of either party or on its own initiative.
 
Article 38 Where an arbitrator has committed a material violation of Article 34(4) or a violation of Article 58(6) of this Law, he shall be held liable according to law and removed from the roster of arbitrators by the arbitration commission.
