Time Period for Rendering an Award in Summary Procedure

Time Period for Rendering an Award in Summary Procedure

When the summary/expedited procedure is applied in international arbitration in China, the time period for rendering an award in the summary procedure is generally no more than half of that in general procedure, for example, three (3) months under the arbitration rules of CIETAC and SHIAC, forty-five (45) days under SHIAC FTZ Arbitration Rules, etc., from the date of appointment of an arbitral tribunal.
The arbitral tribunal, with good cause shown, may request the chairman/president of the arbitration commission to extend the time period for rendering an award. The chairman/president may grant permission if he deems it necessary and proper.
If the proceeding is suspended for any reason whatsoever, the period of such suspension will not be included in the calculation of the time period for rendering an award.
