Applicability of judicial review of arbitration cases
For the purpose of this article, arbitration cases exclude cases involving labor disputes, personal relations (marriage, family, adoption, succession, etc.), administrative disputes under the jurisdiction of government authorities, etc.
According to the Civil Procedure Law and the Rules Pertaining to the Procedures for Arbitration Cases for Judicial Review, issued by the Supreme People's Court in 2017, a disputing party may file a petition for judicial review of an arbitration case for:
- Confirming an arbitral award rendered by an arbitration institution/institute in mainland China;
- Revoking an arbitral award rendered by an arbitration institution/institute in mainland China;
- Recognizing and enforcing an arbitral award rendered in Hong Kong, Macao, or Taiwan;
- Recognizing and enforcing an arbitral award rendered in a foreign country; or
- Other purposes specified by law.
